TheBarokah Affiliate Programme Terms and Conditions

Version 2026-09-29
Effective 29 September 2026 · supersedes version 2026-09-22 (22 September 2026)

1. Acceptance and programme scope

These Terms govern referrals for paid TheBarokah software memberships. They are an agreement between Operator details not yet published on this site: registered legal name, company registration number. and each approved affiliate (“Affiliate”, “you”).

1.1 By submitting an application and, after approval, confirming acceptance in the affiliate dashboard, you agree to these Terms. We keep an electronic record of the version accepted, the date and time, the account that accepted it, and the text of the version as published on that date. Your website account terms and our Privacy Notice continue to apply; these Terms control affiliate programme matters if there is a conflict.

1.2 Participation is limited to promoting subscriptions to TheBarokah software. The programme does not pay for insurance, takaful, investments, financial-product leads, advice, placement, premiums or product sales. No regulated appointment, licence, authority to advise, or right to bind the Operator is created.

2. Eligibility and approval

2.1 You must be at least 18 years old, have legal capacity, submit accurate and current information, control the account and promotional channels identified in your application, and comply with applicable law and any obligation to your employer or principal. If you apply for a business, you warrant that you have authority to bind it.

2.2 Approval is effective only when recorded in the dashboard or confirmed by us in writing. We may accept, refuse or require verification of an application on reasonable commercial, security, compliance or reputational grounds. You must tell us promptly about material changes to your details, ownership, channels or payout information.

2.3 Affiliate access is separate from membership access. We may restrict affiliate functions without necessarily affecting your access to software you have purchased, subject to the terms applicable to that software.

3. Definitions

“Approved Affiliate” means an applicant whose programme approval is active. “Referral Link” means a tracking link issued in the dashboard. “Referred Customer” means a genuine new paying customer attributed under section 5 who is neither you nor a Related Person. “Related Person” means a person or entity you own or control, that owns or controls you, that is under common control with you, or whose purchase you fund or direct primarily to generate commission. “Eligible Payment” means a distinct membership subscription charge actually collected and retained for a Referred Customer, subject to section 4. “Eligible Net Membership Revenue” means the membership line-item amount actually collected, after discounts and credits and excluding indirect taxes, refunds, reversals, chargebacks and excluded purchases. “Validated Commission” means a commission that has completed the pending and review process without reversal.

4. Commission and eligible transactions

4.1 Unless a different rate is recorded for your account before the relevant referral occurs, the commission rate is 20% of Eligible Net Membership Revenue on the first 12 Eligible Payments for each Referred Customer. The first eligible paid subscription charge counts as payment one. No commission arises merely from a click, registration, trial or unpaid invoice. Rates and eligibility for future payments may change under section 11; commission already validated and payable for a payment collected before the effective date of a change remains governed by the prior terms, subject to a valid reversal.

4.2 Subscription payments made during a trial are excluded. Also excluded are single-report or other non-membership purchases, top-ups, services, non-membership products, amounts funded by promotional credits, taxes, failed payments, refunded amounts, chargebacks, and payments by you or a Related Person. We may exclude purchases produced by prohibited methods under section 7.

4.3 Each collected membership billing charge is one Eligible Payment regardless of the period it covers. If a customer changes membership tier, commission is based on the actual eligible amount collected for that billing charge. A free period, a failed charge or a fully refunded charge does not use one of the 12 payments.

4.4 Cancellation stops new commissions while no membership payment is collected. If the same customer reactivates within 180 days, remaining eligible payments continue toward the original limit of 12, provided the customer identity can be reliably matched. Reactivation after 180 days is not a new referral unless we expressly approve it in writing. Transferring a customer to a different account to reset the limit is prohibited.

4.5 Example: if the eligible membership line item actually collected is RM68.00 excluding tax, the commission is RM13.60. A single-report purchase earns no commission.

5. Attribution and tracking

5.1 A valid Referral Link may set a first-party cookie for up to 30 days, subject to the customer’s browser and privacy choices. The programme uses first valid click: the attribution received within the 30-day window before the customer’s first eligible membership purchase is the one that counts, and later clicks do not replace it while that cookie remains valid. The cookie does not renew on a later click unless the earlier attribution has expired.

5.2 The customer must complete the purchase in an environment where our tracking works. Cookie deletion, blocking, device changes, restricted scripts, consent choices and technical failures can prevent tracking. We do not guarantee attribution for untracked activity. Our transaction and referral records are the primary evidence, subject to correction of a clearly documented error.

5.3 We may disregard manipulated, duplicate or invalid tracking, including cookie stuffing, forced clicks, misleading redirects, fake accounts and artificial transactions. We may ask for reasonable evidence when you dispute attribution, while protecting customer privacy. A claim should be submitted through the contact page within 60 days after the relevant purchase, and we aim to respond within 30 days. This administrative period does not remove rights that cannot lawfully be excluded.

6. Pending period, payout and reversals

6.1 Commissions are pending for 30 calendar days after the Eligible Payment is successfully collected. We may extend review for a specific transaction while a refund request, chargeback, suspected fraud, security investigation or payment-provider dispute remains unresolved, and will indicate the affected amount in the dashboard where practicable.

6.2 A commission becomes available only after validation. Once your available balance reaches RM100.00, you may request payment from the dashboard. The first payout additionally requires at least 1 validated sale(s), 30 days of approved affiliate status, complete and verified payout details, and manual review.

6.3 We process approved payout requests monthly. A request submitted by the final calendar day of a month is ordinarily paid on or about the 15th day of the following month, or the next Malaysian business day. Verification, bank processing, an incomplete request, a reasonable compliance review or circumstances outside our control may delay payment; we will communicate a material delay and its reason where reasonably possible.

6.4 A request locks the commissions it includes and the payout destination on file at the time of the request. Changes to payout details apply only to later requests unless we approve an exception after verification. You bear reasonable bank charges imposed on receipt or on currency conversion. No interest accrues on a balance awaiting payout.

6.5 We may reverse an amount attributable to a refund, cancellation, chargeback, failed payment, duplicate credit, fraud, self-referral or breach of these Terms. If the amount has already been paid, we may deduct it from later commissions or seek repayment after giving an itemised explanation. We will not reverse a valid commission solely because the referred customer cancels after the applicable refund and review period, except where a later refund or payment reversal affects the underlying charge.

6.6 Before payment we may request reasonable identity, banking, tax and fraud-prevention information. We may withhold only the amount reasonably affected by a genuine investigation or legal obligation, and will review the hold periodically. Amounts below RM100.00 may remain in the account until the threshold is reached or participation ends; section 11 governs final settlement.

7. Promotion and conduct

7.1 You must describe TheBarokah and its pricing accurately, keep claims current, identify your material connection clearly where you promote it, and state in a prominent place near an endorsement or affiliate link that you may earn a commission. You must comply with applicable advertising, consumer, privacy, communications and professional rules.

7.2 You must not send unlawful or unsolicited marketing; buy or use improperly collected contact lists; impersonate us; make guaranteed savings, investment-return or income claims; present software calculations as personalised regulated advice; promise unapproved discounts; or imply employment, agency, government, regulatory or Shariah endorsement without written authority.

7.3 You must not use spam, fake reviews, deceptive redirects, cookie stuffing, forced clicks, misleading domain names, malware, automated fake traffic, unauthorised incentives or undisclosed cashback, and you may not bid on “TheBarokah” or confusingly similar brand terms in paid search without prior written consent. Sub-affiliates, affiliate networks, paid traffic sources and promotion directed to countries we have not approved for your account require prior written approval. You are responsible for anyone you engage to promote under your account.

7.4 You must not collect a customer’s TheBarokah login credentials or access their financial reports or client records through the affiliate programme. If you separately obtain personal information for your own promotion, you are responsible for a lawful basis, appropriate notice, security and requests to stop direct marketing.

8. Brand and intellectual property

8.1 During approved participation we grant you a limited, revocable, non-exclusive, non-transferable licence to use supplied names, logos, links and creatives solely to promote the programme in accordance with our written brand instructions. All rights remain ours or our licensors’. You may not alter a mark in a misleading way, register a confusingly similar mark or domain, or suggest official endorsement.

8.2 You grant us permission to display your approved affiliate name or channel solely to administer and identify the programme, subject to any branding instructions you supply in writing. On suspension or termination you must promptly stop using our marks and remove programme claims and links from channels you control.

9. Privacy, confidentiality and security

9.1 Affiliate reports may display masked identifiers and commission events, but do not grant access to a customer’s reports, client records or full contact information. Our processing of affiliate data is described in our published Privacy Notice. You must keep credentials secure and promptly report suspected unauthorised access.

9.2 Each party must protect the other’s non-public commercial, technical and personal information received through the programme and use it only for programme purposes, except where disclosure is required by law or the information becomes public without breach. This duty survives termination for three years, and for personal data and trade secrets for as long as applicable law or their confidential nature requires.

10. Taxes and independent status

10.1 You are an independent contractor responsible for your own tax reporting, registration and invoicing obligations. We may request information or documentation reasonably required to process payments or comply with law, and may make deductions or withholdings required by law with available supporting details.

10.2 You have no authority to bind us, enter contracts for us, give financial advice on our behalf, or make representations beyond approved materials. You bear your promotional expenses unless we agree otherwise in writing. No employment, partnership, franchise or fiduciary relationship arises.

10A. International affiliates and restricted territories

10A.1 Applicants outside Malaysia are not eligible merely by applying. We may approve or reject countries, territories, persons, entities, payment destinations and promotional channels in our reasonable discretion, including on legal, payment, tax, sanctions, security and reputational grounds. You must provide your residence or place of incorporation, beneficial ownership where requested, tax residence, payout country, intended audiences and channels, and promptly update changes. Approval for one territory or channel does not extend to another.

10A.2 You must comply with the laws applying to your conduct and the audiences you target, including advertising disclosures, electronic marketing, consumer protection, privacy, professional licensing and local restrictions on financial claims. You must not market into a territory we have excluded or use content we direct you to remove or correct. We may require prior approval of particular claims and materials, restrict links or territories, pause tracking or payments affected by a genuine compliance concern, and suspend or terminate participation in accordance with section 11.

10A.3 You must not hold yourself out as our local office, employee, authorised financial adviser, regulated intermediary, tax agent or person authorised to contract for us. You may not appoint sub-affiliates or representatives in another jurisdiction without our prior written approval. You will not receive customer financial reports, client records or full contact details through the affiliate dashboard.

10A.4 Payout is subject to identity and banking verification, the availability of a lawful payment channel, applicable sanctions and legal restrictions, required documentation and any deduction or withholding required by law. We may defer the affected payment while a genuine legal or payment issue is resolved and will provide an explanation where legally permitted. We make no representation that a particular affiliate payment has a fixed withholding-tax treatment; the position may depend on the facts and the relevant law.

10A.5 Our choice of Malaysian law and courts in section 13 governs disputes between us to the extent permitted by law. It does not displace mandatory law applicable to an affiliate’s promotion or to a customer in another country. You must notify us promptly of a regulator inquiry or third-party claim concerning your promotion. We may seek urgent relief in any court with jurisdiction to protect intellectual property, confidential information or data, without waiving the Malaysian forum for other claims.

11. Suspension, termination and changes

11.1 You may leave the programme through the dashboard or by written notice. We may suspend or terminate immediately for reasonably suspected fraud, serious misconduct, security risk or legal breach; otherwise we may end participation on 14 days’ written notice for commercial or operational reasons. Where practicable we will give a reason and an opportunity to respond to a non-urgent compliance concern.

11.2 On termination, new referrals and future customer payments after the effective termination date do not earn commission, except that valid pending and earned commissions for payments collected before that date remain payable subject to review, reversal and set-off. We will assess and pay available final commissions, including a valid balance below RM100.00, within 60 days after termination or after resolution of a documented open dispute, provided payout details are complete. We may deduct documented sums owed under these Terms.

11.3 To the maximum extent permitted by applicable law we may amend, replace, add to or withdraw these Terms, the commission rate or calculation, eligible products, payment limits, attribution rules, validation period, payout rules, approved territories and channels, and any other programme feature when we consider it in TheBarokah’s interests. We will publish a dated version and communicate material adverse changes through the dashboard or the registered email. Unless law, security, fraud prevention or a payment-provider requirement reasonably calls for earlier action, a material adverse change takes effect no sooner than 14 days after notice. Non-material clarifications may take effect on publication.

11.4 A change applies to referrals and Eligible Payments occurring on or after its effective date, including future subscription payments from previously referred customers, unless a specific written rate commitment expressly states otherwise. A change will not reduce a commission already validated and payable for a payment collected before that date, except for a reversal permitted by section 6 or as the law requires. We may offer more favourable transitional treatment in a change notice.

11.5 After notice, an affiliate who continues to use a Referral Link, makes a new referral or requests a payout on or after the effective date accepts the revised Terms, to the extent permitted by law. For a material change we require a fresh, unticked-box acceptance before continued use; we may pause referral tracking and payout requests until it is given. If you do not accept, you must stop promoting and may terminate your participation. Mere silence does not by itself constitute acceptance. We preserve prior versions and the record of the notice or the affirmative acceptance. Rights that cannot lawfully be varied without further consent remain unaffected.

12. Warranties, liability and indemnity

12.1 Each party will comply with applicable law in performing these Terms. We provide tracking and dashboard information on a commercially reasonable basis but do not promise uninterrupted availability, a minimum number of customers, earnings or perfect attribution.

12.2 To the extent permitted by law, neither party is liable to the other for indirect or consequential loss, lost profit or lost opportunity arising from this programme. Our aggregate liability arising under these Terms is limited to the greater of RM1,000 or the commissions paid or payable to you in the 12 months before the event giving rise to the claim. This cap does not limit liability that cannot lawfully be limited, fraud or wilful misconduct, or our obligation to pay validated commissions properly due.

12.3 You will indemnify us against third-party claims, reasonable costs and losses directly arising from your unlawful or misleading promotion, infringement of third-party rights, misuse of personal data or material breach of section 7, to the extent caused by you or by persons you engage. We will notify you promptly of a claim, allow reasonable participation in its defence, and not settle it in a way that imposes an admission or a non-monetary obligation on you without your consent.

13. Notices, governing law and general terms

13.1 Programme notices may be sent to the email address in your account or displayed in the dashboard. You must keep your contact details current. Formal legal notices to us should be sent to enquiry@thebarokah.com and to our registered address shown at the top of these Terms; notices to you may be sent to your registered email.

13.2 These Terms are governed by the laws of Malaysia. The courts of Kuala Lumpur, Malaysia have exclusive jurisdiction over disputes between the parties, subject to mandatory law that cannot be excluded and the right to seek urgent protective relief under section 10A.5. Before filing a claim either party may request good-faith discussions for 30 days, without preventing urgent relief.

13.3 If any provision is unenforceable the rest remains effective. Delay in enforcing a right is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor operator of the website on notice, provided accrued affiliate rights remain protected. These Terms and any account-specific written rate recorded in the dashboard form the entire affiliate agreement. We retain records of the applicable versions and of your acceptance of them.

14. Contact

Use the site’s contact page for programme, attribution or payout questions. Nothing in these Terms overrides rights or obligations that apply under Malaysian law.
